It is inherently hard, sometimes impossible, to draw the lines. We have copyright regimes designed to do the best we think we can do to promote creativity (whatever that is). Incentives, you know. But legal definitions don't prescribe historical ones.

...the bands we hear on wfmu that seem like they should go places are mostly never going to go far enough that they can give up their day jobs or collect significant royalties for composition.
