Hi Therese and everyone. I love recent Marianne Faithfull. I missed the previous mic break. I’m 49 years old. This past year I’ve really been changing my thoughts about our country and society. I always thought that society moves forward and progresses albeit slowly with many bumps in the road. But with the reactionary turn from the left in regard to the nuances of free speech, the bald faced hypocrisy from the right, the return of war that could ignite nuclear war and now this impending stacked court overturn of Roe I think this is the shittiest I’ve ever seen it. So I’ve been thinking that society doesn’t progress . Now I’ve got to figure out how to sanely live within a retrograde state.

The outcome of this supposed decision is legitimate in one respect: the Court decided it according to its protocols. It very well might not be logically or doctrinally legitimate. It might be a "bad" decision. But guess what? The arbiters of what is a bad decision are the Court (oops, that's a problem) and the legislature.

I'm only complaining--okay, whining--about how folks bitch that the Court is "political." That goes without saying.

The Court is precisely designed NOT to be democratic. Its purpose is precisely to overturn democratically decided laws and policies. This country is not 100% about "majority rules." The Court's job is to check stupid majoritarian policies and laws.

@Dean. No, it is not the job of the Supreme Court or any Court in the US to "check stupid majoritarian policies." The Court should not act as a super legislature or replace the policy decisions of the states or federal government with policies it prefers. The Sup Ct took away a civil right based on what was an unbroken string of its own decisions. "Precedent on precedent" as one person previously put it. The Sup Ct's breaking of stare decisis without any newly arising justification will weaken the rule of law, and the legitimacy of its own court. If you still think that is a "win" then that's on you.

Sorry, Benoni, but you're simply wrong. The "super legislature" argument is not correct. The Supreme Court's job, since Marbury, is to overturn unconstitutional legislation and to overturn bad precedent. And I suspect we all celebrated when the Court did that in, say, Obergefell. Or no? Are you angry that the Court legalized same-sex marriage?

In Australia you have to vote, elections are always on a Saturday and there's loads of early voting options. You get a fine if you don't vote, but everybody does, because why wouldn't you? Vote order on the forms is drawn from a hat in each electorate so dumb votes are averaged. The sheer lack of active democracy in the USA quite baffling to us
