Favoriting Hinky Dinky Time with Uncle Michael: Playlist from August 30, 2024 Favoriting

Uncle Michael's avatar View Uncle Michael's profile Favoriting

Turning over the toy box and jamming together the gloriously mismatched musical Lincoln Logs, Legos and Tinker Toys from Tin Pan Alley pluggers, pickled egg tavern weepers, lockstep soul ensembles, skinny-tie power poppers, Eurotrash ravers, moontanned art school rockers, drunken soccer anthems and anything else that seems like a good idea at the time. There are no guilty pleasures.

💝 i am familiar with food banks. They are creepy scary in s. FL. Waiting hours, expired food, unusable rotted, banned additives, scorching temps and being turned away when you get close to the final pick up agent. And that is if you are lucky enough to own a vehicle. When i see fBanks on tv in other states it just makes it worse. Anyways, Bless YOU.

From ASCAP:

If the campaign events are properly licensed, can the campaign still be criticized or even sued by an artist for playing their song at an event?
Yes. If an artist is concerned that their music has been associated with a political campaign, he or she may be able to take legal action even if the campaign has the appropriate performance licenses. The campaign could potentially be in violation of other laws, unrelated to music licensing:

1. The artist’s Right of Publicity, which in many states provides image protection for famous people or artists

2. The Lanham Act, which covers confusion or dilution of a trademark (such as a band or artist name) through its unauthorized use

3. False Endorsement, where use of the artist's identifying work implies that the artist supports a product or candidate

As a general rule, a campaign should be aware that, in most cases, the more closely a song is tied to the "image" or message of the campaign, the more likely it is that the recording artist or songwriter of the song could object to the song's usage by the campaign.

That ASCAP summary is certainly true. But it's important to recognize that the mere public performance by a campaign of an artist's music, so long as it is "properly licensed," is not a copyright violation, which seems to be the implicit understanding. "Bruce Springsteen wrote and performed that song. You can't take it and use it." But you can. Just don't tread into ASCAP's items 1, 2, or 3.

Speaking of amps, I recently discovered that Dan D'Agostino of Krell notoriety now offers a pair of monoblock amplifiers for a mere $350k. yeah, right. The thing is they have been allowing huge developments to be built over the past 10 years when I don't think those areas have been fully "remediated" and now they're discovering toxic fumes and stuff in pre-existing structures, and people seem to be surprised. It is not done being remediated and it was never fully remediated around the canal, except in certain, specific areas.
