@UM: Yes, I got a job. It is a 9-5 type of deal. Thus: D:O Radio to Sunday mornings.

Amanda:

Ah, well, then I guess I might play it. We'll see. I wrote a short story about "Take It Easy" actually. But it is hard to get stories published that have lyrics in them, so it was a quixotic pursuit.

@Jeff G.: Congratulations to you on the new gig. This puts a new spin on my family's Sunday mornings...

@Amanda: Hard to publish stories with lyrics due to copyright restrictions?
Avatar Swag For Life Member 12:55pm
Amanda:

@Polyus, thanks for sharing! I follow that account, and I agree -- it's amazing. My life has seriously improved like 2% or so since I found it.
Avatar Swag For Life Member 12:56pm
Amanda:

@Dean Exactly. Publishers won't touch it.
  12:56pm
Jeff g.:

Thx @KenHP! I am also loving this set.
  1:00pm
Jeff g.:

Is it the *fourth* album that should always be double live?
  1:00pm
Dean:

Publishers are risk averse idiots. Granted, reproducing an entire song poses a problem, but I'd bet a stanza or so would be fair use. The problem is that the threat of a suit, even one that isn't well-founded, is enough to scare them. And thus the norms that really drive the behaviors of artists and business people--as opposed to the law--are shifted toward risk aversion, and nobody wants to buck them. Of course, you could try to get permission.
  1:03pm
Jeff g.:

Thanks, Dean.
Avatar Swag For Life Member 1:06pm
Nate K.:

This Nude Party jam is cool.
Avatar Swag For Life Member 1:06pm
doctorjazz:

It's especially weird now that you can download or search any lyric out there on line!
  1:06pm
Dean:

You're welcome, Jeff g., unless you're a publisher, and you were being sarcastic, and I've offended you, in which case I'm sorry for painting all publishers as risk averse idiots with one sweep of a broad brush.

You could also parody the lyric, Amanda, which might very well undermine the whole point of quoting it in the first place. I am reminded of a cartoon my kids watch in which a character appears, Jason Wiebler, who sings a song, "Sweety, Sweety." I had to explain to them that the character was a parody of Justin Bieber.
  1:07pm
Dean:

And if you think being my kid and being explained to several times a day approaches child abuse, you're probably right.
  1:08pm
Jeff g.:

I'm to be an editor, Dean, as risk averse as they come! No offense taken whatsoever.
Avatar Swag For Life Member 1:09pm
listener james from westwood:

You've got to be a Stephen King or someone on his level before publishers lay out coin on song permissions for your work. It's almost easier to make up a fake song to quote from (which he did in "The Stand," I guess, but he still could've told his pub. he wanted half of "Hard Day's Night" and they'd likely have run off w/ check in hand).
  1:10pm
Dean:

Editors are rigorous and demanding, but not necessarily risk averse. You know, "il miglior fabbro" and all..
Avatar Swag For Life Member 1:10pm
Amanda:

I actually have come to find it a bit obnoxious when people quote song lyrics too much, because they're usually referencing a song that the reader is meant to know anyway. Musicians do it in their memoirs and it can be hilariously self-aggrandizing.
Avatar Swag For Life Member 1:11pm
listener james from westwood:

Editors are often bold. Their corporate bosses, and the lawyers they retain, are often somewhere on the scale from skittish to craven.
  1:12pm
Jeff g.:

Pynchon's made up lyrics are pretty good </lit-snobbery>
Avatar Swag For Life Member 1:15pm
listener james from westwood:

At my final full-time job, colleagues of mine and I received training on how to use a new video camera, purchased so we could ask conference attendees innocuous questions about the nursing profession and record their responses for use on the magazine's website. THEN we were shown the release form we had to have respondents sign. Two sides of a legal-sized sheet covered w/ fine print invoking all manner of illusory legal horrors. The report back from the conference was that lots of nurses were interested in chatting, but none of them did so upon seeing this Faustian fucking contract.
  1:15pm
Jeff g.:

Ok gotta run. Sorry to miss Simpsons Time™, Amanda, but there's always THE PODCAST.

Thanks!
Avatar Swag For Life Member 1:16pm

Avatar Swag For Life Member 1:17pm
listener james from westwood:

Novelty tracks like this shouldn't be so damned catchy. (See also the Hampster Dance.)
Avatar Swag For Life Member 1:18pm
Nate K.:

I see your point, Dean. But if you quote Henley and Frey without permission and then they come along after the story is published and say, "Oh, hey, that'll cost you $10,000 and there's nothing you can do about it." Are you being a risk-averse idiot or just not wanting to get fucked by the Eagles?
Avatar Swag For Life Member 1:18pm
Amanda:

I don't think you understand, James. Li'l Bub WROTE AND PERFORMED this.
Avatar Swag For Life Member 1:21pm
Nate K.:

Additionally, I think there are ways around writing about pop music in fiction without directly quoting lyrics. George Pelecanos does it a lot. If they're being used for more than just window dressing (which it sounds like might have been the case with your story Amanda), you can always go with fair use, too.

Dean:

I *might* be misrepresenting the law with respect to lyrics (as opposed to any other genre of the written word), but fair use permits quoting portions of Henley & Frey for the purpose of commenting on nature of the comment--criticism, instruction, parody, approval, etc.--and in terms of the nature of the commenting text--non-fiction, fiction, tabular data, etc. Thus, if I were emperor, even a fictional short story that quotes one or two stanzas of a well-known Eagles tune to depict a character's reverie respecting those lyrics would easily satisfy fair use.

"We're slawin' him up good!"

Ack. My comment on commenting barfed. Should read, "...for the purpose of commenting on those lyrics. I mean 'commenting' in the broadest sense, in terms of both the nature of the comment..."
