My personal take is they definately made Boop based on Kane. If you look at the trial they make some wild leaps that didn't stick and were lucky that they found one of Kane's producers who said Kane probay saw Lil Esther perform. They also had video from Esthers live act but this was after Kane was famous and Esther's act was she was a celebrity impersonator so impossible to say what the video showed unless the release it.

For those who aren't already aware, this proceeding occurred in the Appellate Division of NY's Supreme Court, which is not in fact the state's highest court, but its trial court. App Div, however, must have allowed certain appeals at this lower level.
