Man, I got in a Helen Kane rabbithole. Basically the whole of Betty Boop internet is on one side or another of the fallout of blogspot drama from like 2006 about whether or not Helen Kane stole her act from Baby Esther.

Krys O.:

In 1932, when singer Helen Kane sued Fleischer Studios, claiming that they had appropriated her persona for the voice of the cartoon character Betty Boop, the studios defended themselves by arguing that Kane's style of singing—characterized by her baby voice and use of the phrase "boop-boop-a-doop"—was not her own invention. Theatrical manager Lou Bolton testified during the Kane v. Fleischer trial that Kane saw Baby Esther's cabaret act in 1928, in which Esther used interpolated words such as "boo-boo-boo" and "doo-doo-doo".[2] An early test sound film of Baby Esther's performance was used as evidence.[3] Other evidence introduced at the trial included a recording by the Duncan Sisters and testimony from performers such as Bonnie Poe, Margie Hines, and Little Ann Little, who testified that she had been singing in a baby voice and using interpolations such as "bo-de-o-do" for several years.[4] The court ruled against Kane.[2]

MHLee:

@Jan Turkenburg It all comes back to 1930s court transcripts which have never been published in full but I have read a lot of... but basically it goes back to her suing Fleischer over Betty Boop using her likeness and image. Fleischer, which hired three Kane impersonators to play Betty Boop argued Kane had no unique act to steal. They said her "baby talk" was not unique and scat was not unique and her appearance was similar to Clara Bow. It does seem Baby Esther scatted and had baby talk as part of her preformance but the combination of scat, baby talks, and the sexy "baby vamp" was Kane's thing. In the 80s an animator said they based her on Kane.

My personal take is they definately made Boop based on Kane. If you look at the trial they make some wild leaps that didn't stick and were lucky that they found one of Kane's producers who said Kane probay saw Lil Esther perform. They also had video from Esthers live act but this was after Kane was famous and Esther's act was she was a celebrity impersonator so impossible to say what the video showed unless the release it.

For those who aren't already aware, this proceeding occurred in the Appellate Division of NY's Supreme Court, which is not in fact the state's highest court, but its trial court. App Div, however, must have allowed certain appeals at this lower level.

I didn't know it was Frank Gallop until the internet. The song was played often on a late night comedy program on my local classic rock station when I was a kid and I was usually too dumb to listen to the host backannounce who played what, if they did (I don't think they did. I think the comedy show was syndicated package sold to the station).
